In order for Pre pack insolvency to be successful you need to be able to agree a fair value for the assets that you need to transfer. Therefore, it is vital that a valuer who understands the nature of pre pack insolvency and who is willing to show commercial awareness is instructed. We will only use a valuer that we have worked with in the past and that we know we can work with. This gives our clients comfort that everything that can be done to make the transaction work in their favour is being done.
Many Insolvency Practitioners are extremely thorough and over analyse the detail of any transaction making it almost impossible for a pre pack to move forward in a timely manner. We only use commercially minded Insolvency Practitioners that are willing to make quick decisions on a deal. Choosing an Insolvency Practitioner that you do not know is a lottery, we will take this uncertainty away.
There are aspects of an Insolvency pre pack that may require a solicitor to act on your behalf (i.e. obtaining leave of court, or advising on a sale agreement). Again we will recommend one of our trusted solicitors to our clients thereby ensuring that they receive best advice rather than choosing an unknown solicitor.
